Can I file a dispute?

So I ordered a phone almost a month ago now from a wireless carrier. It was supposed to be overnighted. When I tried to track it I had all kinds of problems and the shipping company said my address was wrong (which it wasn't, the address was correct). I waited a few more days hoping it would get straightened out. Eventually it showed they were going to return it to the sender. That was late last month and I contacted the company I bought it from and said it had been two weeks since I was supposed to get it and I wanted a refund. They said they would look into it and update me and give me my refund when they confirmed receipt. I guess by that they mean when they get the package back?

It's been another week and nothing has happened, shipping still shows it's "being returned to sender" for two weeks now and no updates.

I don't know what to do. The shipper won't let me file a claim for the package and I can't get my money back from the phone company until they get the package back.

Since I bought it on a credit card, can I just file a dispute and get my money refunded that way?

I don't even want the phone anymore. I'm going to buy one from another carrier that is offering a better deal anyway. But I can't do that until I get this mess straightened out and get refunded my $250.

You could at least explain the situation to your credit card company (potentially via the dispute process), and they can advise and tell you when the latest date you could do a chargeback would be. Or the credit card company could raise the issue with the phone company to push the process along.

There's not much a merchant can do about a chargeback, the process always trusts the buyer (unless maybe the buyer has made a suspicious number of claims). But it has to be filed within a certain period of time.

Thanks guys. I'm going to call my bank tomorrow and try to start the process. I've got copies of emails and messages so hopefully I'll have enough evidence. I'm really more aggravated with the post service than the phone company itself but like I said they won't let me file a claim, so there's not much else I can do.
