Hmmm, I don't know... I googled it and found this, you could give it a try.
"it may sound stupid but i swear it works connect itouch/phone hold power and home button for 10 seconds let go of power after 10 seconds KEEP HOLD OF HOME BUTTON for about a minute it hurts your finger, but then the screen flashes white and it loads in itunes!!!" |

To reset Press and hold the Sleep/Wake button and the Home button at the same time for at least ten seconds, until the Apple logo appears.

I believe what you can do is go to the apple site and they'll be a page where you can enter the serial # from the back of the ipod and it'll tell you whether or not it's still under warrenty.
